Download PDFThese Conditions of Sale (“Conditions”) set out the terms on which The Rare Corner sells timepieces and objects (“Pieces”) through therarecorner.com and in the course of our direct dealings with you. Please read them carefully before placing an order or reserving a Piece.
By confirming an order, paying a deposit, or otherwise agreeing to acquire a Piece, you confirm that you have read, understood, and accepted these Conditions. Together with our confirmation of your order, they form the contract between us for the sale of that Piece; no other terms apply unless we agree them in writing.
“We”, “us”, and “our” mean The Rare Corner. “You” and “your” mean the person placing an order or acquiring a Piece.
“Piece” means any timepiece or object we offer for sale. “Order” means your request to purchase or reserve a Piece. “Order Confirmation” means the communication (by email or otherwise) in which we confirm our acceptance of your Order. “Deposit” means the sum payable to reserve a Piece under Clause 5. “Website” means therarecorner.com.
Every Piece we offer is vintage or pre-owned and is sold as a unique object in its current condition. Each is described and photographed to the best of our knowledge and experience.
Signs of age, wear, patina, and prior service consistent with a Piece’s era are inherent to vintage and neo-vintage watches and are not defects. Servicing over the working life of a watch, and occasionally the replacement of individual components, is entirely normal for vintage and neo-vintage pieces and is not a fault. Where we are aware of any servicing or replaced parts, we are glad to share what our inspection and records show — just ask us about any individual Piece. Measurements and specifications are approximate and provided for guidance.
Colour and appearance may vary depending on your device and display, which we cannot guarantee.
Every Piece is examined in-house by our experienced specialists before it is offered for sale, and is accompanied by a written statement of authenticity recording our assessment. We are independent dealers and specialists, not a brand-authorised service centre, and we describe each Piece on that basis. Where we are unable to confirm any aspect of a Piece, we say so plainly and do not represent otherwise. We guarantee that every Piece we sell is genuine: in the unlikely event a Piece is found to be counterfeit, we will refund it in full on its return in the condition supplied. Signs of age, servicing, restoration, or replacement parts consistent with a vintage or neo-vintage watch are inherent to such watches and are not grounds for a claim under this guarantee.
Where a Piece retains its original box, papers, certificate, or other accompanying documents, this is stated in its description. Unless expressly stated, the absence of original box or papers does not affect the authenticity of the Piece.
You must be at least 18 years old to place an Order. Our Pieces are available to both private collectors and trade buyers.
Each Order you place is an offer to purchase a Piece on these Conditions. An Order is not accepted, and no contract is formed, until we issue an Order Confirmation (or, where a Piece is reserved, until we confirm receipt of your Deposit). We may acknowledge receipt of an Order before accepting it; any such acknowledgement does not constitute acceptance.
We may decline or cancel an Order at our discretion, including where: the Piece is no longer available; there has been an error in the listed price, description, or specification; we are unable to verify your identity or payment; we suspect fraud or unauthorised use of a payment method; or completing the sale would breach applicable law or sanctions. If we decline or cancel an Order after payment, we will refund the amount paid for the affected Piece.
A Piece may be reserved with a Deposit of 20% of the agreed price. The Deposit is non-refundable.
The balance is due within five (5) business days of the reservation, unless we agree otherwise in writing. If the balance is not received within that period, the reservation may lapse, the Piece may be returned to general availability, and the Deposit is forfeited.
A Piece is not held or reserved for you until we have received and confirmed your Deposit or full payment.
Prices are as listed on the Website or as quoted to you directly, and are confirmed at the point of sale. We may vary prices at any time before an Order is accepted, but will not change the price of a Piece after we have issued an Order Confirmation for it.
We accept the payment methods set out at checkout or as agreed with you directly. Payment must be made in the currency in which the Piece is priced. You are responsible for any charges imposed by your bank or card issuer.
Title to a Piece passes to you only when we have received payment in full. Until then, the Piece remains our property.
We ship worldwide. All shipments are fully insured in transit and dispatched by a tracked, secure courier. Shipping and insurance costs are borne by the buyer unless we agree otherwise.
We will make reasonable efforts to dispatch within the timeframe indicated, but any delivery date is an estimate only and we are not liable for delays outside our reasonable control. Risk in a Piece passes to you on delivery.
Upon delivery, and before signing for the Piece, you should inspect the packaging. If it appears damaged or tampered with, note this on the courier’s delivery record and contact us promptly.
You are responsible for any import duties, taxes, or customs charges applicable in the destination country. We do not ship to PO boxes.
If you are not satisfied with a purchase, you may return it within fourteen (14) days of receipt, provided it is in the same condition as delivered, unworn and unaltered, with any security seals, tags, and accompanying items intact, and accompanied by proof of purchase.
On approval following our inspection, we will refund the price paid for the Piece, less the original outbound shipping cost, to the original payment method, within a reasonable period. Return shipping and insurance are the buyer’s responsibility unless the return relates to a fault or an error on our part.
Where a return falls outside these conditions, we may instead offer to buy the Piece back on terms to be agreed. Bespoke, specially altered, or specially sourced items may not be eligible for return. Nothing in this clause affects any rights you may have under applicable law.
Where we provide servicing, restoration, authentication, or valuation, the specific scope, turnaround, fees, and any warranty are set out and agreed at the time the service is arranged, and those specific terms govern that service.
Where you purchase in the course of a business, certain protections available to consumers may not apply. Trade buyers acquire Pieces on the basis of their own inspection and expertise, subject to our written statement of authenticity and these Conditions.
Nothing in these Conditions excludes or limits our liability for fraud, for death or personal injury caused by our negligence, or for any liability that cannot be excluded or limited under Hong Kong law.
Subject to the above, our total liability in respect of any Piece is limited to the price paid for it, and we are not liable for any indirect or consequential loss.
These Conditions, and any dispute or claim arising out of or in connection with them, are governed by the laws of Hong Kong and subject to the exclusive jurisdiction of the courts of Hong Kong.
If we do not enforce, or delay enforcing, any right under these Conditions, that does not waive it. If any provision is found invalid or unenforceable, the remaining provisions continue in full effect. No person other than you and us has any right to enforce these Conditions.
